Ga. man who killed a fellow prisoner to be executed Tuesday, clemency denied

ATLANTA (AP) The Georgia Board of Pardons and Paroles has denied clemency for a death row inmate set to die Tuesday evening. <br /> <br /> Warren Lee Hill, who is 54, is set for execution at 7 p.m. He still has a petition pending before the U.S. Supreme Court. <br /> <br /> Hill was serving a life sentence in 1990 for the 1986 slaying of his girlfriend when he killed a fellow inmate. A jury in 1991 convicted Hill of murder and sentenced him to death. <br /> <br /> Hill's lawyers have long argued he is intellectually disabled and therefore shouldn't be executed. The state has consistently argued Hill has failed to prove beyond a reasonable doubt that he is intellectually disabled. <br /> <br /> Georgia has the toughest-in-the-nation burden of proof for capital defendants seeking to avoid execution on grounds of intellectual disability.
